About Mediation
Mediation is a process where a neutral third person called a
mediator acts to encourage and facilitate the resolution of
disputes between two or more parties. It is an informal and
non-adversarial process with the objective of helping the
disputing parties reach a mutually acceptable and voluntary
agreement.

In mediation; unlike arbitration, decision making authority
rests with the parties. The role of the mediator includes; but
is not limited to, assisting the parties in identifying issues,
fostering joint problem solving, and exploring settlement
alternatives.

Mediators handle Circuit Civil, County Civil and Family cases
but others handle appeals and dependency cases.
Mediation is also being used in other settings such as
resolving disputes in the workplace and between patients.
doctors and hospitals.

Mediation is governed by Florida Statute 44, Rule
1.700-1.830 of the Florida Rules of Civil Procedure.

There are many advantages to mediation as an alternative
to litigation. First, mediation allows the parties to decide their
case, as opposed to a judge or jury. Second, mediation
allows the case to be resolved on the timetable set by the
parties. Third, it is usually less expensive than paying an
attorney.
